    John W. Whitehead is an attorney and author who has written, debated and practiced widely in the area of constitutional law and human rights. Whitehead's concern for the persecuted and oppressed led him, in 1982, to establish The Rutherford Institute, a nonprofit civil liberties and human rights organization whose international headquarters are located in Charlottesville, Virginia. Whitehead serves as the Institute's president and spokesperson, in addition to writing a weekly commentary that is posted on The Rutherford Institute's website (www.rutherford.org), as well being distributed to several hundred newspapers, and hosting a national public service radio campaign. Whitehead's aggressive, pioneering approach to civil liberties issues has earned him numerous accolades, including the Hungarian Medal of Freedom.

    Whitehead has been the subject of numerous newspaper, magazine and television profiles, ranging from Gentleman's Quarterly to CBS' 60 Minutes. Articles by Whitehead have been printed in the New York Times, Los Angeles Times, the Washington Post and USA Today, among others.

    Whitehead gained international renown as a result of his role as co-counsel in Paula Jones' sexual harassment lawsuit against President Clinton. Whitehead continues to speak out in defense of a woman's right to be free from sexual harassment and frequently comments on a variety of legal issues in the national media.     The author of numerous books on a variety of legal and social issues, as well as pamphlets and brochures providing legal information to the general public, Whitehead has also written numerous magazine and journal articles. In addition, he wrote and directed the documentary video series Grasping for the Wind, as well as its companion book, which focus on key cultural events of the 20th Century. The series received two Silver World Medals at the New York Film and Video Festival and is now available on DVD. His latest book "A Government of Wolves: The Emerging American Police State" earned him two prestigious national book awards.

    Whitehead has filed numerous amicus briefs before the U.S. Supreme Court. He has also been co-counsel in several landmark Supreme Court cases as well. His law reviews have been published in Emory Law Journal, Pepperdine Law Review, Harvard Journal on Legislation, Washington and Lee Law Review, Cumberland Law Review, Tulsa Law Journal and the Temple University Civil Rights Law Review.

    Born in 1946 in Tennessee, John W. Whitehead earned a Bachelor of Arts degree from the University of Arkansas in 1969 and a Juris Doctorate degree from the University of Arkansas School of Law in 1974. He served as an officer in the United States Army from 1969 to 1971.

    Nuala O'Connor is the President & CEO of the Center for Democracy and Technology. She is an internationally recognized expert in Internet and technology policy, particularly in the areas of privacy and information governance. Nuala is passionate about the ways technology and the Internet can be instruments of global free expression and individual freedom, and is committed to finding policy solutions that affect real people.

    Nuala has experience in both the public and private sectors. She was the Global Privacy Leader at General Electric (GE), where she was responsible for privacy policy and practices across GE's numerous divisions. Prior to joining CDT, she worked at Amazon.com as Vice President of Compliance & Consumer Trust and Associate General Counsel for Data & Privacy Protection.

    Nuala's time in the technology sector began at DoubleClick, where she was part of a team of professionals brought in to address public outcry over the advertising giant's proposal to merge on- and offline data sets. She managed numerous class actions, a multistate settlement with state attorneys general, and an FTC investigation before going on to help found the privacy compliance department, which served as an influential model for companies in the technology sector and beyond.

    Later, Nuala served as Deputy Director of the Office of Policy & Strategic Planning, Chief Privacy Officer and as the Chief Counsel for Technology at the US Department of Commerce, where she worked on global technology policy including Internet governance and industry best practices. She became the first statutorily appointed Chief Privacy Officer in federal service when she was named as the first Chief Privacy Officer at the Department of Homeland Security. At DHS she was responsible for groundbreaking policy creation and implementation regarding the use of personal information in national security and law enforcement. Under her leadership, the DHS Privacy Office issued a seminal report criticizing the use of private-sector data in national security efforts.

    She serves on numerous nonprofit boards, and is the recipient of the International Association of Privacy Professionals (IAPP) Vanguard Award, the Executive Women's Forum's Woman of Influence award, and was named to the Federal 100, and "Geek of the Week" by the Minority Media & Telecom Council in May 2013. She also served as the Chairman of the Board of IAPP.

    Born in Belfast, Northern Ireland, Nuala grew up in and around New York City. She holds an AB from Princeton, an M.Ed. from Harvard, and a JD from Georgetown University Law Center.

    Jodi Pratt is a pioneer and leader in fraud risk management for the financial services field, with more than 35 years of experience in retail bank operations and technology development.     Since leaving Bank of America in 1996, Jodi has worked as an independent consultant and commercial solutions vendor. As a consultant, she helps financial institutions refine and update their fraud prevention programs, addressing their strategic direction, organizational structure, policies and procedures and technological support. Also, she provides educational programs to keep fraud risk professionals up-to-date on existing and emerging trends and fraud prevention techniques, and offers expert witness advice and testimony in bank operations and fraud-related lawsuits.

    Jodi is frequently a speaker to industry groups worldwide on fraud detection, prevention and risk management and has written many articles and white papers on risk issues.

    Ms. LeRoy is the leader of an innovative pro bono program in Skadden's Palo Alto office focused on educating Bay Area high school teens about laws relating to social media usage and related misconduct. The program aims to empower teens to be good citizens online and to deter unlawful conduct. Ms. LeRoy has trained organizations and other Skadden attorneys to enable the program's expansion. Carrie was recognized by The Recorder with a 2014 "Legal Innovators" award for her work in this area.

    Joanne McNabb is the Director of Privacy Education and Policy in the Privacy Enforcement and Protection Unit in the California Department of Justice. The Unit protects Californians' constitutionally guaranteed right to privacy, enforces state and federal privacy laws, educates consumers and businesses, and makes recommendations to the Attorney General on privacy matters.

    McNabb is a Certified Information Privacy Professional, with specializations in Government and Information Technology. She serves on the Privacy Advisory Committee to the U.S. Department of Homeland Security and is a Fellow of the Ponemon Institute, a research center on privacy, data protection and information security policy.

    From 2001 until 2012, McNabb directed the California Office of Privacy Protection, which was a resource and advocate on privacy issues.     He specializes in patent, trademark, copyright, and trade secret cases and has tried dozens of cases in his career.     After successful 22-year tenure with United States Secret Service, Ron Williams entered private sector security, opening what has become a premier security consulting suite of companies, Talon Companies. As Chief Executive Officers of Talon Executive Services, Inc., Secure Strategies International, LLC and Talon Cyber Tec, LLC, Williams is involved with all aspects of security consulting, including critical infrastructure protection requiring Top Secret clearance.

    During his career with the Secret Service, Williams had the opportunity to work and supervise all divisions of the SS Treasury department in the Los Angeles Field Office, including supervision of the credit card and financial fraud squad, the counterfeit squad and the elite Counter Assault Team (CAT) to combat terrorism.

    As the Lead Advance Agent, Mr. Williams was responsible for all advance security plans and logistics coordination for Presidential, Vice-Presidential, and foreign heads-of-state visits to Los Angeles, personally protecting Presidents Ford, Reagan, Bush, and Clinton, as well as such noted dignitaries as Queen Elizabeth, Yitzhak Shamir, and Pope John Paul. Williams was the recipient of numerous awards including the United States Secret Service Director's Award for Special Achievement on eight occasions.

    In 1994, his focus turned toward private security and he formed what would become the first of the Talon Companies, Talon Executive Services, Inc., a private security consulting firm that combined best practices of private sector security with USSS protection protocols.

    In the wake of 9/11, Talon was called upon to conduct Risk & Vulnerability Assessments to critical infrastructures such as water districts and transportation authorities, resulting in a specialized branch of security now handled by Secure Strategies International, LLC. As a Talon company, Secure Strategies has access to all the resources of Talon while specializing on projects that require top-secret security clearance.

    As the evolution of security assessments and protection continued, the need to blend physical security with IT security became increasingly evident. As new protocols were developed and this blend of security more clearly defined, Talon Cyber Tec, LLC was created to oversee specific projects.

    Because of his expertise in the field of anti-terrorism, Mr. Williams was asked by the California Gubernatorial delegation in 2002, to meet with Tom Ridge regarding homeland security. His association with AFAUSSS (Association of Former Agents of the United States Secret Service), ASIS (American Society of Industry Security), ATAP (Association of Threat Assessment Professionals) American Water Works Association (AWWA) Association of California Water Agencies (ACWA) to name a few, keeps him abreast of all matters involving security and threat assessment.     Evan Zucker

    Evan Zucker practices in the areas of consumer class actions, bad faith insurance litigation, employment class actions and real estate litigation. Mr. Zucker is dedicated to fighting for individual rights as well as protecting the rights of consumers who have been harmed by the unlawful acts of others.

    Before joining Kabateck Brown Kellner, Mr. Zucker was involved in obtaining a quarter billion dollar settlement on behalf of auto insurance policyholders who were being charged excessive rates. He also worked vigorously to recover hundreds of millions of dollars on behalf of commercial and residential policyholders faced with catastrophic losses.     Carl works at the NTIA Privacy Multi-Stakeholder process, speaks on panels about burdens to e-commerce, and testifies before state legislatures on proposed legislation. Recently, Carl met with FTC Commissioners on new COPPA regulations, presented on mobile-app privacy at the IAPP Annual Conference, and worked with the Maryland Child Privacy Taskforce.

    Before joining NetChoice, Carl was an intellectual property attorney at the lawfirm of Wildman, Harrold, Allen & Dixon where he advised clients on privacy, Internet, e-commerce, and contractual matters. He also worked at the law-firms of Venable and Arnold & Porter.

    Carl also worked on copyright, trademark, and anti-piracy both for Motion Picture Association of America (MPAA) and the Entertainment Software Association (ESA).

    Before law school, Carl worked at the Federal Trade Commission (FTC) on the staff of Commissioner Orson Swindle, where he helped create and implement the FTC's Consumer Information Security Outreach Plan and assisted the White House in establishing the National Strategy for Cyber Security.

    Beth Givens is founder and director of the Privacy Rights Clearinghouse (PRC), established in 1992. The PRC is a nonprofit consumer education and advocacy organization, based in San Diego, California. Its mission is to engage, educate and empower individuals to protect their privacy. Givens and her organization represent the interests of consumers in public policy proceedings at the state and federal levels. She and her colleagues are often interviewed by the media on consumer privacy issues.

    The PRC's many consumer guides cover a broad range of informational privacy topics, including: credit reporting, identity theft, data breaches, online privacy, medical records, workplace issues, online data brokers, employment background checks, computer security, debt collection, education, telemarketing, and smartphones.

    Givens co-authored a chapter on identity theft in Protection, Security and Safeguards (2nd ed,, 2013). She contributed a chapter on consumer and privacy rights to the 2006 book, RFID: Applications, Security and Privacy. She authored the encyclopedia entries on identity theft for Encyclopedia of Privacy (2007), World Book Encyclopedia (2004) and Encyclopedia of Crime and Punishment (2002). Givens is author of an early book on informational privacy, The Privacy Rights Handbook (Avon, 1997), and is co-author of another early guide, Privacy Piracy: A Guide to Protecting Yourself from Identity Theft (1999), with Mari Frank, Esq.

    Mary-Alice has a history of fighting for the disadvantaged, powerless and mistreated. After 20 years as a public sector lawyer, Mary-Alice launched her private law practice in 2003. Her personal experiences as a public-sector whistleblower continue to drive and focus her on employment and civil rights matters, and particularly on whistleblower retaliation. Mary-Alice especially relishes taking on public sector defendants -- and the lawyers and bureaucrats who represent them. But she also loves standing up to big corporate entities as well.

    The firm's very first jury trial resulted in a multi-million dollar verdict against a national private school that fired its local director for refusing to disobey California's teacher-to-student-ratio laws (Scott v. Phoenix Schools, Inc.). Other successful verdicts include: a race discrimination verdict on behalf of an African American psychologist terminated by the California Department of Corrections and Rehabilitation (Renfro v. CDCR); an age discrimination verdict for a 65-year-old career counselor fired after delivering a gift to a counselee (Rosales v. Career Systems Development Corp.); and more recently, a large verdict against the Regents of the UC in favor of a nurse researcher who was fired after reporting the failure to obtain IRB approval of research on prisoners at San Quentin prison (Keyzer v Regents of the University of California). Other representative successes include settlements of: a sex harassment and discrimination suit against a large school district (Greenwalt v. Twin Rivers USD); reversal of MSJ in an age discrimination case against UC Davis (Silen v. Regents); a whistleblower retaliation case against the County of San Joaquin (Pizano v. County of San Joaquin); a disability discrimination suit against a local water district; a disability discrimination case involving a nurse fired by major hospital corporation after she developed hearing loss; a long-time city employee fired after a disabling on-the-job injury necessitated surgery that caused life-threatening complications; successful class actions against FedEx (Taylor v FedEx) and Halloween City (Wilkening v. Halloween City); and resolution of legal complaints against major corporations such as McDonald's, The Permanente Medical Group, Inc., and Starbucks.

    Mary-Alice advocates for her clients inside and outside the courtroom. She has testified numerous times at the state Capitol and has advocated at the U.S. Capitol on statutory changes needed to protect employees. She regularly advocates before county governments, city councils, and local commissions and boards. One legislative effort included the 2010 enactment of whistleblower retaliation protections for UC employees, for which both Mary-Alice and her client, former-UC nurse researcher Janet Keyzer, testified. Mary-Alice had a primary role in drafting the California Dispute Resolution Programs Act (authored by then- Sen. John Garamendi) and a major statutory rewrite of the California Small Claims Act. She has authored and edited a number of consumer law and self-help publications, including the Consumer Law Sourcebook for Small Claims Judicial Officers, published by the California Department of Consumer Affairs.

    Mark Mao

    Hsiao (Mark) Mao, Vice Chair of both the Technology Practices Group and Financial Services Practice Group at Kaufman Dolowich & Voluck, LLP works out of the firm's San Francisco and Los Angeles offices.

    Mr. Mao's practice focuses primarily on mobile, cloud, and big-data companies, with a particular interest in their software, licensing, and privacy law needs.     Mariah Brandt

    Mariah Brandt is an experienced civil litigator and trial attorney in Pillsbury's Los Angeles office. Her practice focuses on business litigation, including intellectual property matters, contract disputes, insurance coverage for policyholders, and consumer privacy cases. Ms. Brandt has litigated a wide variety of complex matters and class actions across a range of industries, including entertainment, restaurant, food and beverage, banking and technology.

    Ms. Brandt has served as lead counsel in several jury trials.     Deborah C. Peel, MD is the nation's leading advocate for patients’ rights to control access to sensitive personal health information in electronic systems. The lack of health privacy causes millions of people to avoid early diagnosis and treatment for cancer, depression, and STDs every year. She became an expert and privacy warrior to stop patients from being harmed. She is a practicing physician and Freudian psychoanalyst.

    Her passion is educating the public about privacy-enhancing technologies, architectures, policies, and laws, so they can advocate to restore their civil and human rights to health privacy.

    In 2002, amendments to HIPAA eliminated patients’ longstanding rights to control personal health information. The right of consent was replaced with "regulatory permission for covered entities to use and disclose health records for treatment, payment, and healthcare operations." The Amended HIPAA Privacy Rule put institutions in control of the use, disclosure, and sale of patients’ health information, from DNA to diagnoses to prescription records. Patient control over health data was eliminated.

    In 2004, she formed Patient Privacy Rights (PPR), a 501c3 non-profit organization to educate Americans about the importance of health privacy. PPR is the world’s leading consumer health privacy advocacy organization, with over 12,000 members in all 50 states. In 2006, Dr. Peel founded the bipartisan Coalition for Patient Privacy. The coalition membership includes over 50+ national organizations, representing 10.3 million people who want to control the use of personal health information. In 2007, Microsoft Corporation joined the Coalition.

    In 2009, the Coalition for Patient Privacy worked to ensure historic new privacy and security protections were added to HITECH, the technology portion of the stimulus bill. Protections included: a ban on sales of protected health information (PHI) without consent, audit trails for disclosures of PHI from EHRs, the ability to segment sensitive PHI, meaningful breach notice, the right to block disclosure of PHI for healthcare operations if treatment is paid for out-of-pocket, and requiring encryption.     Mary Anne Franks is an Associate Professor of Law at the University of Miami School of Law, where she teaches criminal law, criminal procedure, and family law. She is also the Vice-President of the Cyber Civil Rights Initiative (CCRI), a non-profit organization dedicated to challenging online harassment and abuse. In that capacity, she has worked with legislators in 16 states to draft legislation against the non-consensual distribution of sexually explicit images, and is now working with Congresswoman Jackie Speier (D-CA) on federal legislation.

    After receiving her J.D. from Harvard Law School in 2007, Prof. Franks became a Bigelow Fellow and Lecturer in Law at the University of Chicago School of Law. Before law school, Prof. Franks received her doctorate in 2004 and master's degree in 2001 from Oxford University, where she studied on a Rhodes Scholarship. Before entering legal academia, Prof. Franks was a Lecturer at Harvard University, teaching social theory, philosophy, and literature.

    Prof. Franks is a frequent legal commentator in the media on issues of criminal law, family law, and cyberlaw.     Current Scope of Practice

    John Stephens focuses his practice on media and entertainment litigation, intellectual property licensing and transactions, and specialty insurance coverage and litigation. Mr. Stephens handles matters for a diverse client base. His entertainment and media clients include media entities, magazines, television and radio stations, production companies, entertainment technology companies, computer technologies, online content and software providers, and talent. Additionally, Mr. Stephens represents clients in the manufacturing, financial, and insurance industries.

    Mr. Stephens focuses his practice on enforcement and litigation of copyright, trademark, trade dress, trade secret, and false advertising matters. He counsels clients on protecting intellectual property rights, as well as handles intellectual property transactions, such as software licenses, product licenses, rights-sharing agreements, and merchandising and branding deals.

    Mr. Stephens also represents insurers in all aspects of coverage, the preparation of coverage opinions, claims investigation, litigation and trial. He also counsels insurers on claims handling procedures, loss prevention and assist with drafting policies.

    Mr. Stephens is admitted to practice before the United States Courts of Appeals for the Ninth Circuit and for all districts of the United States District Court for the State of California. He served as the chair of the Tort Trial & Insurance Practice Sections’ Intellectual Property Committee for the 2009– 2010 and 2010–2011 terms, where he was also the co–editor of the committee’s newsletter. In addition, he was one of 21 admitted to the TIPS Leadership Academy of the American Bar Association for 2009–2010. Since 2010, Mr. Stephens has served on the National Board of Directors for the Gay & Lesbian Alliance Against Defamation (GLAAD) and formerly a co–Chair of GLAAD National Board of Directors.     Michael Kaiser joined the National Cyber Security Alliance in 2008.     Ransome has 23 years of government service, which includes ten years as a computer scientist and geospatial imagery intelligence analyst, weapons of mass destruction threat credibility assessment analyst and senior NEST key leader for DOE/Lawrence Livermore National Laboratory, three years as US Special Agent for the Naval Criminal Investigative Service (NCIS), and a retired Naval Intelligence Officer (Commander) with twenty-three years combined active and reserve service for the U.S. Navy and the U.S. Marine Corps as a Weapons Platoon Sergeant and Intelligence Specialist.

    He holds a Ph.D. in Information Systems and developed/tested a security model, architecture, and provided leading practices for converged wired-wireless network security for his doctoral dissertation as part of a NSA/DHS Center of Academic Excellence in Information Assurance Education program. He is a member of Upsilon Pi Epsilon, the International Honor Society for the Computing and Information Disciplines, a Certified Information Security Manager (CISM), a Certified Information Systems Security Professional (CISSP), and a Ponemon Institute Distinguished Fellow.

A veteran of multiple trials, he focuses his practice on intellectual property litigation, pre-litigation counseling, commercial disputes, and election law. He has represented clients in numerous industries, including the semiconductor, medical device, TV broadcasting, video game, telephone headset, and bio-pharmaceutical industries. He has an extensive background in redistricting and campaign finance law and has advised various clients and campaigns in such areas. He is also the founder of GLW's Video Game practice group. Mr. Lowenstein has been selected as a "Rising Star" lawyer and a 2014 "Super Lawyer" in Southern California by Los Angeles Magazine, one of the youngest attorneys to be selected for this honor.

    Mr. Lowenstein previously practiced for many years at Irell & Manella LLP in Los Angeles. He was a redistricting consultant to the California State Senate and the California Democratic Congressional delegation. He was the Executive Director of the successful No on Proposition 77 campaign, and has appeared on many television and radio programs involving election issues. During law school, Mr. Lowenstein was a legal intern to the Vice Chairman of the Federal Election Commission.     Kathryn F. Russo is Deputy General Counsel and an Associate in the Los Angeles office of Goldberg, Lowenstein & Weatherwax LLP. Ms. Russo is a Certified Information Privacy Professional in U.S. private-sector privacy laws and regulations (CIPP/US). She focuses her practice on compliance, governance, and litigation, with particular attention to cutting-edge data privacy issues. Ms. Russo advises emerging companies on privacy and data security compliance, policies, and procedures.

    Ms. Russo began her career as a finance associate in the New York office of Pillsbury Winthrop Shaw Pittman LLP, where she gained experience in transactional issues, including structured finance and securitizations. Ms. Russo also has extensive experience as debtor's counsel in complex bankruptcy cases. In 2007, Ms. Russo was the recipient of the Pillsbury Stimson Pro Bono Fellowship and spent her fellowship year working for Human Rights Watch, one of the world's leading independent organizations dedicated to defending and protecting human rights.

    Dr. Ann Cavoukian is recognized as one of the leading privacy experts in the world. Noted for her seminal work on Privacy Enhancing Technologies (PETs) in 1995, her concept of Privacy by Design seeks to proactively embed privacy into the design specifications of information technology and accountable business practices, thereby achieving the strongest protection possible. In October, 2010, regulators from around the world gathered at the annual assembly of International Data Protection and Privacy Commissioners in Jerusalem, Israel, and unanimously passed a landmark Resolution recognizing Privacy by Design as an essential component of fundamental privacy protection. This was followed by the U.S. Federal Trade Commission's inclusion of Privacy by Design as one of its three recommended practices for protecting online privacy - a major validation of its significance.

    An avowed believer in the role that technology can play in the protection of privacy, Dr. Cavoukian's leadership has seen her office develop a number of tools and procedures to ensure that privacy is strongly protected, not only in Canada, but around the world. She has been involved in numerous international committees focused on privacy, security, technology and business, and endeavours to focus on strengthening consumer confidence and trust in emerging technology applications.

    Dr. Cavoukian serves as the Chair of the Identity, Privacy and Security Institute at the University of Toronto, Canada. She is also a member of several Boards including, the European Biometrics Forum, Future of Privacy Forum, RIM Council, and has been conferred a Distinguished Fellow of the Ponemon Institute. Dr. Cavoukian was honoured with the prestigious Kristian Beckman Award in 2011 for her pioneering work on Privacy by Design and privacy protection in modern international environments. In the same year, Dr. Cavoukian was also named by Intelligent Utility Magazine as one of the Top 11 Movers and Shakers for the Global Smart Grid industry, received the SC Canada Privacy Professional of the Year Award and was honoured by the University of Alberta Information Access and Protection of Privacy Program for her positive contribution to the field of privacy. Most recently in November 2011, Dr. Cavoukian was ranked by Women of Influence Inc. as one of the top 25 Women of Influence recognizing her contribution to the Canadian and global economy.
